We reserve the right to decline any job that we believe is unsafe, unlawful, beyond our capacity, or otherwise unsuitable. We may also refuse to transport certain prohibited or restricted items as set out in these Terms and Conditions.

Booking Process

Customers may request a quotation or make a booking through our online forms, written communication, or other agreed channels. All bookings are subject to availability and confirmation by us.

When making a booking, you must provide accurate and complete information, including but not limited to:

1. Full collection and delivery addresses.

2. Floor levels and access details, including lifts, stairs, parking restrictions, and any distance from parking to the property entrance.

3. An accurate description and approximate volume or list of the goods to be moved.

4. Any special handling requirements, such as fragile, heavy, bulky, or valuable items.

5. Any items that require disassembly or reassembly.

6. The preferred date and time window for the service.

Your booking is not confirmed until we have accepted it and, where required, received any applicable deposit or prepayment. We may amend or withdraw a quotation or booking offer if the information you provide is inaccurate, incomplete, or changes materially before the service date.

Quotations and Pricing

Unless stated otherwise, quotations are estimates based on the information supplied by the customer. Quotations may be provided as a fixed price or on an hourly rate basis, with minimum booking periods as advised at the time of booking.

We reserve the right to adjust the final price if:

1. The scope of work differs from that originally described.

2. Access is more difficult or time-consuming than advised, including stairs, long carrying distances, parking problems, or waiting times outside our control.

3. Additional items are added on the day that were not included in the original quotation.

4. The job takes longer than anticipated due to circumstances beyond our reasonable control.

Any changes to the agreed price will be explained to you as soon as reasonably practicable.

Payments and Charges

Payment terms will be confirmed at the time of booking. We may require partial or full payment in advance, particularly for larger moves, long-distance journeys, or peak times.

Accepted payment methods will be advised directly and may include card payments, bank transfers, or other non-cash methods. Where payment on completion is agreed, full payment is due immediately upon completion of the service on the same day, unless otherwise stated in writing.

If payment is not received by the due date, we reserve the right to:

1. Charge reasonable late payment fees or interest in accordance with applicable UK law.

2. Withhold delivery of goods until payment is received in full, where legally permissible.

3. Cancel or suspend any future bookings.

All prices are quoted exclusive of any congestion charges, toll fees, parking charges, fines, or similar costs, unless expressly stated. You are responsible for reimbursing any such charges reasonably and necessarily incurred by us in the performance of the services.

Customer Responsibilities

The customer is responsible for:

1. Ensuring suitable parking for our vehicle at both collection and delivery addresses, and covering any associated charges or permits.

2. Obtaining any necessary permissions or permits for access to buildings or properties.

3. Packing goods safely and securely, unless packing services have been specifically agreed.

4. Ensuring that all appliances are disconnected, defrosted, drained, and prepared for transport.

5. Supervising loading and unloading where possible, and checking that nothing is left behind at the property.

6. Declaring any fragile, high-value, or unusual items in advance.

If access is restricted, unsafe, or not as described, or if there are delays caused by the customer, additional charges may apply, or we may be unable to complete some or all of the services.

Cancellations and Amendments

You may cancel or amend your booking by giving us notice as early as possible. The following cancellation terms will generally apply, unless otherwise stated in writing:

1. Cancellation more than 48 hours before the scheduled start time: no cancellation fee, and any deposit may be refunded or transferred to a new booking at our discretion.

2. Cancellation between 24 and 48 hours before the scheduled start time: we may charge up to 50 percent of the quoted price or retain any deposit paid.

3. Cancellation within 24 hours of the scheduled start time, or failure to be present or allow access at the agreed time: we may charge up to 100 percent of the quoted price.

Amendments to the date, time, or scope of work are subject to availability and may result in a revised quotation. If we cannot accommodate your requested changes and you choose to cancel, the above cancellation terms may still apply.

We reserve the right to cancel or reschedule a booking due to unforeseen circumstances, such as vehicle breakdown, severe weather, staff illness, or safety concerns. In such cases, we will notify you as soon as reasonably practicable and offer an alternative date or a refund of any payment made for the affected service. We will not be liable for any indirect or consequential losses arising from such cancellation or rescheduling.

Delays and Waiting Time

We will use reasonable efforts to arrive at the agreed time, but timing is not guaranteed. Delays can occur due to traffic, accidents, road closures, weather conditions, or other circumstances beyond our control.

If we are delayed, we will aim to keep you informed and complete the work as soon as reasonably possible. We accept no liability for any loss, damage, or expense arising from delays outside our reasonable control.

Where delays are caused by the customer, including waiting for access, payment arrangements, or incomplete packing, we may charge waiting time at our standard hourly rates, subject to any minimum charges in the booking confirmation.

Liability and Insurance

We will take reasonable care when handling your goods. However, our liability is subject to the following limitations and exclusions, to the fullest extent permitted by UK law.

We will not be liable for:

1. Loss or damage arising from incorrect or inadequate packing by the customer.

2. Loss of or damage to fragile items that were not adequately protected or declared as fragile.

3. Damage caused by inherent defects, weaknesses, or pre-existing damage in goods.

4. Loss of data or records from electronic devices, computers, or similar items.

5. Indirect or consequential loss, including loss of profits, loss of use, or loss of opportunity.

Our liability for loss of or damage to goods, where we are found to be at fault, may be limited to a reasonable amount having regard to the value of the goods and the charges paid for the service. Higher-value items must be declared in advance so that we can discuss suitable arrangements. If you require additional insurance cover, you are responsible for arranging this independently unless we expressly agree otherwise.

You must notify us in writing of any loss or damage as soon as reasonably practicable and, in any event, no later than seven days after the completion of the services, giving full details and reasonable evidence. Failure to do so may prejudice our ability to investigate and may limit or extinguish any potential liability.

Excluded and Restricted Items

We do not carry or store any of the following items, and accept no liability for them whether or not they are disclosed:

1. Explosives, firearms, ammunition, or weapons.

2. Flammable, hazardous, or toxic substances, including gas cylinders, paints, solvents, and chemicals.

3. Perishable goods, live animals, or plants.

4. Cash, precious metals, jewellery, watches, or similar high-value items.

5. Important documents, such as passports, deeds, securities, or financial instruments.

If such items are included without our knowledge, they are carried entirely at your own risk, and you will be responsible for any resulting loss, damage, or legal consequences.

Waste and Disposal Regulations

Man and Van Kentish Town operates in accordance with relevant UK waste and environmental regulations. We do not remove or dispose of waste unless this has been specifically agreed as part of the service. Any removal of waste, rubbish, or unwanted items may be subject to additional charges.

We will not carry hazardous, clinical, or regulated waste. Where we agree to remove general household or office items for disposal, these must be lawful to transport and dispose of. You confirm that any items presented for disposal are your property and that you have the right to dispose of them.

We reserve the right to decline the removal of any items that, in our reasonable opinion, may breach waste regulations, pose health and safety risks, or be inappropriate for transport in our vehicles.

Health and Safety

Our team will follow reasonable health and safety practices at all times. We may refuse to move items that are excessively heavy, unsafe to lift, or cannot be moved without risk of injury or damage.

You must ensure that the premises are safe, that walkways are clear, and that any known hazards are disclosed to us in advance. We are not responsible for injuries or accidents arising from unsafe premises outside our control.

Complaints

If you are dissatisfied with any aspect of our service, you should raise the issue with the team on the day where possible, so that we have an opportunity to address it immediately. If the issue is not resolved, you may submit a written complaint with full details of your concerns, including any supporting evidence.

We will review your complaint and respond within a reasonable timeframe. Our investigation may require information from our staff, review of photographs or job records, and any other relevant material. We aim to resolve complaints fairly and proportionately.

Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay is due to events beyond our reasonable control. This includes, but is not limited to, extreme weather, natural disasters, accidents, acts of terrorism, civil unrest, strikes, pandemics, government restrictions, or major road disruptions.

Personal Data

We may collect and use personal data such as your name, address, and contact details for the purposes of providing our services, handling bookings, processing payments, and managing customer relationships. We will handle such data in accordance with applicable UK data protection laws and retain it only for as long as reasonably necessary for these purposes or as required by law.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

You and Man and Van Kentish Town agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.

Amendments to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. The version in force at the time of your booking will apply to that booking. Continued use of our services after any changes take effect will constitute your acceptance of the updated terms.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be considered deleted, but such deletion shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and Man and Van Kentish Town in relation to the services provided. No other statement, representation, or promise shall form part of this agreement unless expressly agreed in writing.
